1. About Us

TAWI Watamu ("TAWI", "we", "us") is a small hotel offering room stays and curated tours & safaris from Watamu, Kenya. By using our website or making a booking enquiry, you agree to these Terms & Conditions.

2. Enquiries & Bookings

Submitting an enquiry form does not constitute a confirmed booking. A booking is confirmed only when:

• You have received written confirmation from TAWI Watamu, and
• A deposit or full payment has been received as agreed

We reserve the right to decline any enquiry at our discretion.

3. Availability Holds

When you submit a booking request through our availability system, we may place a 24-hour soft hold on your requested dates. This hold is not a confirmed booking. If we cannot confirm within 24 hours, the hold is released and dates become available again. You will be notified by email either way.

4. Pricing

All prices shown on our website are indicative and subject to change. Final pricing is confirmed in writing at the time of booking. Prices are quoted in the currency stated and do not include international transfer fees or taxes unless explicitly stated.

5. Cancellation & Refunds

Cancellation terms vary by room and season and will be stated clearly in your booking confirmation. In general:

• Cancellations more than 30 days before arrival: deposit refunded minus an administration fee
• Cancellations within 30 days of arrival: deposit non-refundable
• Cancellations within 7 days of arrival: full stay amount non-refundable

We strongly recommend purchasing travel insurance to cover unforeseen cancellations.

6. Guest Responsibilities

Guests are responsible for:

• Treating the room and its contents with care
• Reporting any damage promptly to our team
• Adhering to the maximum occupancy stated in the booking
• Complying with local laws and regulations during their stay

TAWI Watamu reserves the right to recover costs for any damage beyond normal wear and tear.

7. Tours & Activities

Tours and activities arranged through TAWI Watamu are operated by licensed local operators. Participation is at the guest's own risk. We strongly recommend appropriate travel and activity insurance. TAWI Watamu acts as an agent and is not liable for incidents during third-party operated activities.

8. Limitation of Liability

To the maximum extent permitted by law, TAWI Watamu's liability for any claim arising from a booking or use of our services is limited to the total amount paid for the booking in question. We are not liable for indirect, consequential or incidental losses.

9. Governing Law

These Terms & Conditions are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.

10. Privacy

Your personal data is handled in accordance with our Privacy Policy.
